A government aided minority high school is running for the last 70 years in a wakf property. The Mutawalli is getting rental from the school. The headmaster of the school is also a self inducted member in the managing committee of the school which had been selected not elected several years back. As the other members in the managing committee do not know the governing laws of government aided minority school, they are being dominated by the headmaster. The school headmaster who has a political bent of mind for a particular political party which is now out of power, doesn’t want to implement the present government’s scheme which are for the benefit of the minorities. A local NGO had started free coaching classes in the same school after school hours with the permission of the headmaster. Later on the NGO wanted to expand the coaching classes with the help of the Urdu Academy which grants some financial support provided the Urdu language is also taught. But the headmaster who is neither the owner of the school, nor remains in the school after 4 PM, disallowed the NGO from running the coaching classes any further after knowing that the West Bengal Urdu Academy was financing the coaching projects of the NGO. He put the condition that he will allow the coaching if the classes are not tagged with the Urdu Academy. Later on it was ascertained that the headmaster had himself taken the financial grant from Urdu Academy for running the classes in the school in collaboration with the Urdu Academy which was later on detected to be bogus in the surprise check by the officials of the academic and being dissatisfied with the explanation of the headmaster of the school they blacked listed the school and stopped the grant. This act of the Urdu Academy infuriated the headmaster and due to an avenging attitude he stopped the further coaching by the said NGO in the school premises . Be it mentioned that the NGO is running with a different name and is a registered one . Due to want of space they are only using the classrooms of the school in which apart from others the students of that is school also take coaching . Moreover there is no nominee from the government in the managing committee or if there is any, he’s not attending any meeting of the school and has not been seen from several years. The school is running in a hay way manner at the sole discretion of the headmaster. I would like to ask the respected members having proficiency in the education rules whether (1) the headmaster has any limitation of power for allowing an NGO after school hours by permitting or not permitting him to run free coaching classes? (2) What is the status of the managing committee which had been formed without any election about 5 years ago? (3) Whether a headmaster of the school can also act as the member of the managing committee of the school on the strength of selection and not election ? (4) Under which rule or law , government aided minority schools are governed in West Bengal? (5) What is the period of stay of the teachers/headmaster in a school and after how many years he or any teacher of the school becomes eligible for transfer from one school to another school? What are the steps which are necessary to curtail the misuse of the power by the headmaster of the school or by the managing committee for taking an arbitrary decision when the managing committee has only been formed by selection and not by election ? Which is the correct forum of the government where the school administration is accountable and complaint can be made for the Redressal of the grievances as well as for regular checking in the school by the Education Department ? I would request the honourable members to suggest some rulebooks or the reference of the books/manual, if any, which can be helpful for me to guide the aggrieved parties. What I believe is that the headmaster doesn’t want to implement any new scheme of present state government for the minority education because of his personal political beliefs. Thanks in advance.
December 4, 2012 at 4:06 am #75835AnonymousInactiveGet to know the procedure of formation of M.C. HM is ex-officio member and hence, need not be elected. I think HM cannot allow NGO to run coaching classes inside school premises even after school hours as it is in no way officially related to the school. If NGO is permitted, why can’t other teachers render such benevolent service in addition to normal duties for the benefit of poor students and academic improvement of the school? Any matter regarding school administration can be referred to MC first, failing which it can be taken with DI or DSE in subsequent stages!
