The Hon’ble High Court at Calcutta, in its order passed on 15.02.2012 in the above matter has directed to issue Circular that the National Emblem without ‘Satyameva Jayate’ should not be used by the department or that the said Emblem can not be used at a place where the said office or the authority has no right to use the same.
The department has, time to time, issued Circulars to take appropriate action to ensure proper use of the National Emblem by all concerned, in keeping with the provisions contained in State Emblem of India (Provisions of Improper Use) Act, 2005.
The Hon’ble High Court, in its said order, has also observed that in spite of advertisements published in the newspapers, no steps have been taken by the errant users of the National Emblem and also ordered that if any person violates the order passed by the Hon’ble Court, Rule will be issued against him and taken up in the proper Jurisdiction of contempt.
It is requested, in compliance of the said order of the Hon’ble Court, to take appropriate action to ensure proper use of the National Emblem and also to keep a constant watch so that no violation is made by any person/ persons/ associations and others who are not actual user of the same under the provisions of law.
