West Bengal Heritage Commission (Terms and Conditions of Service of the Chairperson, Member and the Secretary) Rules, 2003

NOTIFICATION

In exercise of the power conferred by clauses (a) and (b) of Sub-section (2) of Section 26 of the West Bengal Heritage Commission Act, 2001, (West Ben. Act IX of 2001), the Governor is pleased hereby to make the following rules:-

1. Short title:-

(i) These rules may be called the West Bengal Heritage Commission (Terms and Conditions of Service of the Chairperson, Member and the Secretary) Rules, 2003.

Definitions-

In these Rules, unless the context otherwise requires:-

(a) “Act” means the West Bengal Heritage Commission Act, 2001 (West Bengal Act IX of 2001);

(b) “allowance” means honorarium, traveling allowance, daily allowance, conveyance allowance etc. admissible to the members and employees of the Commission;

(c ) “Chairperson” means the Chairperson of the Commission;

(d) “Commission” means the West Bengal Heritage Commission established under Section 3 of the Act.

(e) “employee” means a person appointed to a service or a post in connection with the affairs of the Commission and includes the Secretary of the Commission;

(f) “member” means a member of the Commission and includes the Chairperson;

(g) “section” means a section of the Act;

(h) “Secretary” means a person appointed by the State Government under Section 9 of the Act for the management of the affairs of the Commission;

(i) “State Government” means the Government of West Bengal in the Department of Information & Cultural Affairs.

(ii) Words and expressions used in these rules are not defined, but defined in the Act, shall have the meaning respectively assigned to them in the Act.

2. Salaries, honorarium and other allowances, payable to and the other terms and conditions of service of the Chairperson and other members of the Commission:-

(i) A Chairperson shall receive an honorarium of Rs. 500/- per sitting of the meeting.

(ii) Other members shall receive Rs.400/- per sitting of the meeting.

Provided that a member, who is an employee of the State Government shall not be entitled to such an honorarium.

(iii) The Chairperson and the members of the Commission shall be entitled to such traveling allowance and daily allowance in respect ofjourneys performed in connection with the work of the Commission as are admissible to a Group ‘A’ Officer of the State Government.

Provided that if a member of the Commission is a State Government employee, he shall be entitled to draw the traveling allowance and the daily allowance in accordance with Travelling Allowance Rules applicable to him.

(iv) The Chairperson and the members of the Commission shall be entitled to such leave and medical benefit as are admissible to Group ‘A’ Officers of the State Government.

Provided that if a member is a State Government employee, he shall be entitled to such leave which he enjoys under the West Bengal Service Rules, Part-1.

3. Tenure of service of the Secretary:-

The Secretary shall hold office for a period of three years.

Provided that the State Government may extend the tenure of the Secretary for a further period of three years in consultation with the Commission.

Provided further that the Secretary may, by writing under his hand and address to the State Government, resign his office any time.

4. Salary, honorarium and other allowances payable to and the other terms and conditions of service of the Secretary of the Commission:-

i) A Secretary may be –

(a) a person holding the post not below the rank of a Joint Secretary in the State Government on deputation;

(b ) a person with expertise in heritage research or conservation or management.

ii) The Secretary shall be entitled to payment of travelling allowances and daily allowances as per his entitlements in respect of journeys performed in connection with the work of the Commission at the rate as admissible to Group ‘A’ Officers of the State Government.

iii) The Secretary of the Commission shall be entitled to leave and medical allowances as admissible to the State Government employees under the West Bengal Service Rules, Part – I.
