NOTIFICATION
WHEREAS, the Rent A Motor Cycle Scheme, 1997, published vide S. O. No. 375(E) of the MoRTH dated 12/05/1997, in terms of provisions of section 75 of the Motor Vehicles Act, 1988, permits use of motor cycles as transport vehicles plying on hire;
AND, WHEREAS, S.O. 1248(E) dated 05/11/2004 allows use of motor cycle as transport vehicle;
AND, WHEREAS, in terms of section 2(35) of the Motor Vehicles Act, 1988, “Public Service Vehicle” means any motor vehicle used or adapted to be used for the carriage of passengers for hire or reward, inter alia;
AND, WHEREAS, in terms of section 2(47) of the Motor Vehicles Act, 1988, “Transport Vehicle” means a public service vehicle amongst other types of vehicles;
AND, WHEREAS, applications for issuance of Licence under the said scheme have been received by the State Government from time to time;
AND, WHEREAS, after due consideration of the matter the State Government is satisfied that the issuance of Licence under the scheme mentioned hereinabove, will serve greater public interest;
NOW, THEREFORE, the Governor is hereby pleased to direct that motor cycles can be registered as contract carriages in this State and permits issued by the Regional Transport Authorities of this State in terms section 74(1) of the Motor Vehicles Act, 1988, provided the operator obtains a licence in terms the Rent A Motor Cycle Scheme, 1997 issued by the State Transport Authority, West Bengal.
The Notification will come into force with effect from the date of its publication in the Official Gazette.
