The following Act of the West Bengal Legislature, having been assented to by the Governor, is hereby published for general information:-

West Bengal Act IX of 2026
THE WEST BENGAL COMMISSION FOR BACKWARD CLASSES (AMENDMENT) ACT, 2026.

An Act to amend the West Bengal Commission for Backward Classes Act, 1993.

Whereas it is expedient to amend the West Bengal Commission for Backward Classes Act, 1993, for the purposes and in the manner hereinafter appearing;

It is hereby enacted in the Seventy-seventh Year of the Republic of India by the Legislature of West Bengal, as follows:-

1. Short title and commencement.

(1) This Act may be called the West Bengal Commission for Backward Classes (Amendment) Act, 2026.

(2) It shall come into force on such date as the State Government may, by notification in the Official Gazette, appoint.

2. Amendment of section 3 of West Ben. Act I of 1993.

In clause (d) of sub-section (2) of section 3 of the West Bengal Commission for Backward Classes Act, 1993 (hereinafter referred to as the principal Act), for the word “a Secretary”, the words “a Joint Secretary or above” shall be substituted.

3. Amendment of section 4.

In section 4 of the principal Act, for sub-section (1), the following sub-section shall be substituted:-

“(1) Every Member shall hold office for a term of three years from the date he assumes office:

Provided that the tenure of the Member Secretary who is in the service of the State Government shall be for such period as the State Government may, by order, specify.”.

4. Substitution of new section for section 9.

For section 9 of the principal Act, the following section shall be substituted:-

“9. Function of the Commission.

(1) The Commission shall examine requests from citizens for inclusion of any class of citizens as a backward class in the lists and tender such advice to the State Government as it deems appropriate for inclusion of any such class in the list or otherwise.

(2) The Commission shall hear complaints from citizens of over-inclusion or under-inclusion of any backward class in such lists.

(3) The advice of the Commission tendered under this section shall be ordinarily binding upon the State Government.”.
