MEMORANDUM

Sub: Incorporation of a clause in the NIeT for building works of value less than Rs. 25.00 crore, composite in nature, having predominantly civil works with electrical components less than 25% of the total estimated amount put to tender.

Reference: 1. Memorandum No. 242-W(C)/1M-132/15 dated 20.05.2015 of Works Branch, PWD;

As per usual practice of PWD, composite tenders, involving Civil and Electrical works, are being invited for building works.

However, it is being frequently observed that the Civil contractors participating in the composite tenders mostly do not have requisite credentials for the electrical works leading to unnecessary delay in execution of such projects.

As per extant Govt. Order, Joint Venture is not allowed for works less than Rs. 25 Crore. However, the Engineer Officers of PWD are coming up with proposal for incorporation of a new clause in such composite NIeT to facilitate Joint Venture for building works for works less than Rs.25 Crore.

Now, after careful consideration of the entire matter, the Governor has been pleased to incorporate a new clause in such composite NIeT to facilitate Joint Venture for building works for works less than Rs. 25 Crore such that for works worth value less than Rs. 25 Crore and which are predominantly civil work in nature with electrical components less than 25% of the estimated amount put to tender, the Civil contractor may be allowed to submit an agreement in non-judicial stamp paper of requisite value with an electrical contractor for execution of the electrical components of the work. In that case, the electrical contractor will have to qualify for all requirements set forth in the NIT for electrical works including credential, electrical supervisor’s certificate of competency (SCC) etc. The Civil contractor will have to qualify for all requirements set forth in the NIT including requisite credential for Civil component of such works but excluding credential and SCC requirements for electrical works. However, the onus and full responsibility for execution of the total work (Civil & Electrical) will be on the civil contractor who will execute the agreement with the Department. Payment will also be made to the civil contractor only.
