MEMORANDUM

Sub: Imposing of restrictions on bidders as per Memorandum bearing F. No. 6/18/2019 – PPD dated 23.07.2020 of Ministry of Finance, Government of India

Government of India, Ministry of Finance, Department of Expenditure, Public Procurement Division vide its Office Memorandum bearing F. No. 6/18/2019 – PPD dated 23.07.2020, has imposed certain restrictions as per which any bidder from a country which shares a land border with India will be eligible to bid in any procurement whether of goods, services (including consultancy services and non – consultancy services) or works (including subcontracts and turnkey projects) only if the bidder is registered with the Competent Authority.

Accordingly, the Governor is pleased to declare that such restrictions will also be imposed upon all relevant tender/quotation/bid documents invited by the State Government or any PSU, Autonomous and Statutory Organisations, Urban and Rural Local Bodies, Grant-in-Aid institutions under the Administrative control of West Bengal Government.

The Competent Authority as per this order will be the appropriate authority of Government of India State Government will not be acting as a competent authority under any conditions.

All the procuring authorities under the Administrative control of the Government of West Bengal are required to take necessary measures for insertion of a suitable clause in tender document as specified in Annexure III of the Memo No. F. No. 6/18/2019 – PPD dated 23.07.2020 of the PPD, Department of Expenditure, Ministry of Finance, Govt. of India.

This order shall not apply to:

(i) cases where orders have been placed or contract has been concluded or letter/notice of award/acceptance (LoA) has been issued on or before the date of this order, and

(ii) cases falling under Annex II of the O.M of Govt. of India referred to above.

This order takes immediate effect.
