Sub: Granting of 2 (two) additional increments in favour of teacher(s) working in non-Government aided Secondary Schools having Ph.D Degree.

With reference to above, the undersigned is directed to say that it has come to the notice of this Department that 2 (two) additional increments are not being granted to some teachers who entered into service in the Secondary Schools (s) despite their having Ph.D Degree in the relevant subject taught in the school(s) and, as such, the question of granting such benefit to a number of teachers appointed either through SSC or on the basis of rules prescribed before coming into effect of the Control of Expenditure Act, 2005 had been under consideration of the State Government for some time past. In this connection, attention is invited to Clause 5 of Rule 16 dealing with Career Advancement Scheme laid down in ROPA Rules, ’98 which provides that all secondary teachers/ Headmasters/ Headmistress with Doctorate Degree in the subject taught or in an allied subject shall get two additional increments from the date of the convocation on which such degree is/ was awarded.

In view of this provision and in order to accord opportunity to all such teachers/ Headmasters/ Headmistress in the academic interest without any privilege and prejudice to any one of them, Government in the School Education Department has decided that the teachers acquiring Post Graduate Degree after having had the basic qualification of Honours Degree in the relevant subject and subsequently improving their qualification by acquisition of Ph.D Degree in the relevant subject or those who are appointed with such higher degree in the above noted subject in their possession after having acquired Honours Degree in the regular course and then P.G. Degree in the relevant subject shall get 2 (two) additional increments from the date of convocation on which such degree is/ was awarded. This benefit in terms of Rule 12(5) of G.O. No. 25-SE(B)/1M-102/98, dated 12.02.1999 under ROPA Rules, ’98 is extended up to 18th August, 2005 as a cut-off date, i.e. till before the publication of the Control of Expenditure Act, 2005. All such pending cases can be disposed of accordingly.

This order issues with the concurrence of F.D. vide their U.O. No. 3426-Gr.P(Service), dated 07.12.2011.

    We should jointly go to WB govt for the exact order i.e. the Ph.D holder school teachers after sept. 2005 are eligible or not for additional increments. Otherwise we should jointly do case in high court. Do you agree friends.

    I have got PhD Provisional Certificate on relevant subject on 2009. But the Convocation was held on 05th Jan.2010.The Govt. order dated 5th Jan 2012 whereby ban was imposed on the grant of incremental benefits to the teachers acquiring PhD degree after 18th Aug’2005 cannot be retained and the said Govt. order dated 5th Jan’12 is, thus, quashed by the Hon’ble High Court. In these circumstances, As per Hon’ble High Court’s order (W.P.NO. 20049 (W) of 20012, A.D.I have granted two additional increments vide order memo No. 04/1(2) /Law (me) and No. 04/Law (secretary of school), dated 06.08.2013 w.e.f.05.01.2010 (date of convocation of Ph.D Degree.), So I inform

    Sir,
    I have honour to draw your kind attention to the fact that in pursuance of Hon’ble High Court’s order (W.P.NO. 20049 (W) of 20012, I was granted two additional increments from your office vide order memo No. 04/1(2) /Law (me) and No. 04/Law (secretary of school), dated 06.08.2013 w.e.f.05.01.2010 (date of convocation of Ph.D Degree.), but unfortunately neither two increment nor any arrear has been allotted in favour of me till date.

    Hence I fervently hope and believe that you will be kind enough to take necessary action to grant me two additional increments and arrear at the earliest.

    After that the A.D.I has revoked his order himself due to no provision such incremental benefit of ROPA,2009. But………?

    Clarifications of ROPA, 2009 Last updated on: March 11, 2014
    If promotion to higher post involves assumption of duties and responsibilities of greater importance, a Government employee for such promotion will get the benefit of 3 percent increment in terms of Rule 11 of the WBS (ROPA) Rules, 2009, even though Grade Pay of the officiating promotion post is lower than the ‘Grade Pay’ drawn by him for holding higher non-functional scale(s)
    At the above circumstance, Can A.D.I revoked the order???

    And secondly, is there any news about Govt’s thought on issuing any G.O. to allow benefits to those also who have done PhD after 2005 ?

    News form different media says that recently (in March & April 2013) some important judgements were given by the Hon’ble high court of Kolkata about the additional increments for PhD (convocation date after 2005).
    Can any one provide the Case Numbers of those petitions?

    I am very grateful to you. You told me that I am elegible for two increments. I have sent a lot of letters to D. I. asking for additional two increments . But he did not answer. When I visited him ,he told me that there is no circular from the Government.
    Please advice me what can I do.I will await your advice.

    From newspapers and your site it appears that, from 4.7.2012 a number of judgments rendered by the Hon’ble H.C. of Kolkata to allow 2 additional increments to the Ph.D. holders regardless of the year of getting the degree.

    Did any of those petitioners actually get the benefit after the judgements?

    What is the stand of the WB Govt./ finance dept./ education dept. regarding the judgement?

    Did any current Govt. order issued regarding this?

    I joined as an Asst Teacher in Hons/PG post in 23rd December 2003 with Hons Scale. I completed my MSc in August 2004 with study leave sanctioned from the Education Department. After that I joined another school in PG scale in 27th September 2007.
    My query is: Am I eligible to have the effect of PG scale during the period Aug 2004 to Sept 2007?

    The Convocation Date was 03-9.-2010 ( relevent teaching subject ) on which I received my Ph. D Certificate from the University of Kalyani. Am I eligible to get 2 additional incremental benefit?

      Yes, you can hope to get the benefit if other conditions are satisfied.           Yes, D.I. is correct. D.I. is not the competent authority to allow benefits. He performs duty on behalf of the Director of School Education. Unless there is any Govt. Order issued from the School Education Directorate, giving instructions to D.I.s for release of financial benefits to the eligible teachers D.I.s can’t take any action on the basis of Court verdicts. As soon as the D.I. receives such a prayer from a teacher he may refer the case to the Director of School Education for necessary action. Pls be informed that now a days the court order is case-specific. Govt. takes necessary action in respect of that person who is involved in the particular court case.I mean it is applicable to him for whose favour such verdict is issued. Therefore, though other persons are ‘similarly situated’ they may not be considered by the Govt. Therefore, it is advisable to seek legal justice if you do not get any response from the D.I. despite two/three reminders.

            In earlier times I also beleived in your line of thinking. But recently on 17.05.2013 the honourable high court as given a land mark judgement. Mr. Mehbub Isha of murshidabad appealed to D.I. for his P.Hd incremental benefit giving reference to the order of the high court in which it has out ruled the applicabililty of controll of expenditure act 2005 which has been re-confirmed by educatiob deptt. in January 2012. Inspite of this D.I. dare to reject his appeal. Seeing this act of the D.I. the Honourable high fined him a sum of Rs.5000.00 which will be deducted from his salary. You can see the order of the court also. W.P. no. 13606W, 2013 date of judgement is 17.05.2013.

    I would like to inform you that Govt. accorded Post-facto approval of 2(two) additional increments for obtaining Ph.D.degree in (EDUCATION) in favour of me,vide G.O. No.85/SE(S)/5P-89/09,dated 11.01.2012 of School Education Department (Secondary Branch).
    Govt. also instructed to District Inspector Of Schools(S.E.),Barrackpore,24Pgs to issue a Post- Facto approval letter in favour of me for abtaining Ph.D. degree w.e.f. 06.04.1993,vide G.O. No.85/1(3)-SE(S)/5P-89/09,dated 11.01.2012.But till today no approval letter issued by the D.I. of schools(S.E.) Barracpore,24Pgs. in favour of me.
    Please let me know,what should I do in this current situation.

      I obtained Ph. D. degree in 2004 during in service as Selection Grade Lecturer in Physics at Sonamukhi College, Bankura. I have been deprived from getting two incremental benefit without any reason.
      My query is: Am I eligible to get 2 additional incremental benefit?

    Sir, I have done my Ph. D. in 2009 and why shall I be kept out of enjoyment of two addl. increments whereas my seniors with same degree will enjoy the benefit? It is against the Findamental Fights of the Constitution (Art. 14 and 16) where “Right to Equality” and “Equal Protection of Law” is stated. Pl. do not discriminate between citizens with same degree.

      Your right is well protected by law. See the comments passed by the Hon’ble H.C. of Kolkata in Sauvik Ghosh case (No. MAT 940 of 2007 dated 08.04.2008). Also consult the relevant judgments rendered by the Hon’ble H.C. of Kolkata in Writ Petitions such as (1) WP No. 4532(W) of 2012 dated 04.07.2012 (Chowdhury Moniruzzaman vs. the State of WB), (2) WP No. 5324(W) of 2012 dated 19.07.2012, (3) WP No. 5239(W) of 2012 dated 19.07.2012, (4) WP No. 5847(W) of 2012 dated 25.07.2012, (5) WP No. 6937(W) of 2012 dated 21.06.2012.

    My wife was apptd. in hons scale in1996 and passed MA exam in 1999. Her last dt. of exam was 15 june and month of increment was august. When she opted for MA scale it was revealed that her basic pay in MA scale in 01.01.2006 would be less than her basic pay in HONS. scale. Since the basic pay of 01.01.2006 is to be taken for the fixation of salary as per ropa 2009. she would be in loss forever. SO, although her last dt. of exam was 15 june 1999, can she opt. to remain in hons. scale till the month of her increment ( august) and move to MA scale after taking increment in hons. scale? IF not then would you suggest aSolution?

    I have been apptd. in hons. scale. I passed my MSC in 2008 and last dt. of exam was 28.04.2008. Perm. to draw pg scale was granted, before ropa 2009. my month of incrm. was april. now may i please know how my scale would change from hos. to pg scale? Will there be an addl. increment as per ropa 2009 in this matter?

      The Convocation Date was 27-3-2006 on which I received my Ph. D. Certificate. But on 25-7-2005, I acquired Ph. D. Degree as per the Certificate issued by the Registrar of the University. Am I eligible to get 2 additional incremental benefit.

          I joined at a HS school on 13.3.2006 with PhD degree.
          PhD awarding date (with provisional certificate) : 1.5.2003
          Convocation date : 13.5.2006.

          Can I get 2 additional increment for my PhD?
