Compensation to Family Members of Polling Personnel dies On Duty

No. 2452-Home (Elec)/R3E-66/2004, Dated: 14.06.2004

The question of enhancement of compensation to family members of a Polling/Counting Personnel who dies in due performance of election duty has been under active consideration of the government for sometimes past.

After careful consideration of the matter, the Governor has now been pleased in partial modification of Home (C & E) Department G.O. Nos: (i) No. 2000-Home (Elec), dated 25.1.1998; (ii) No. 3093-Home (Elec), dated 25.08.1999; & (iii) No. 2196-Home (Elec) dated 08.05.2001 to decide as follows:-

i) the employee viz. Polling/Counting Personnel who dies out of accident, violence, commotion, rioting etc shall be paid a Special Compensation of Rs 5,00,000/- (Rupees Five lakh) only;

ii) the employee viz Polling/Counting Personnel who will die a natural death out of strenous work while in due performance of election shall also be paid a Special Compensation of Rs 5,00,000/- (Rupees Five lakh) only.

The Governor has further been pleased to decide the injury cases in the manner as detailed below:-

a) permanent incapacitation involving two limbs or two eyes or one eye one limb.Rs 1,00,000/­
b) loss of one eye or one limb.Rs 50,000/-
c) permanent total disablement or injury other than these mentioned herein before at Paras (a) and (b).Rs 1,00,000/-
d) permanent partial disablement.Percentage of Rs 1,00,000/- as per the general insurance table of compensation.

In case of minor injuries the criteria shall be as follows :-

In case of injuries caused under similar circumstances requiring hospitalisation for 7 (Seven) days or more, the compensation may be determined and it may vary between Rs. 2,500/- to 10,000/- depending on the seriousness of the injury.

For minor injuries compensation will be limited to the reimbursement of the actual medical expenses.

The quantum of compensation to the injured personnel may be determined by a Committee consisting of District Election Officer/ Returning Officer, Superintendent of Police and Chief Medical Officer of Health for the district and for Kolkata area, the Committee shall consist of District Election Officer, D.C. of Kolkata Police and one representative of the Medical Department. The compensation may vary depending on the seriousness of the injury. It should however be limited within the actual expenses to be borne by the incumbent.

The employee concerned as above may also have to remain on leave for a considerable period being absent from his normal duty. Such absence of his may be treated as spent on duty, provided he produces a certificate to the effect that he was under treatment under a Registered Medical Practitioner or Hospital.

In the case of anyone who suffers serious illness while in due performance of election duty shall be entitled to reimbursement of medical expenses he will have to bear or incur with the approval of Health & Family Welfare Department and Finance Department as a normal procedure but very promptly.

The principle will also apply in cases of employees/ persons who are drafted for eletion duty for short-time and on a non-regular basis.

The Chief Electoral Officer, West Bengal, is authorised to sanction the compensation on receipt of the recommendation from the District Election Officer/ Returning Officer.

This order issues with the concurrence of Finance (Audit) Department, U/O No. 1456 Gr. ‘P’ (Service), dated 28.4.2004.
