[in WP 27619(W)/14]Mr. Biswabrata Basu Mallick, learned
advocate appears and submits that the six petitioners in
W.P. 27619(W) of 2014 are not willing to proceed further
with this writ petition. It is further submitted by him that
these six petitioners had approached Mr. Soumen Kumar
Dutta, learned advocate with a letter dated November 25,
2014 expressing that they are not interested to proceed
further and it is alleged that Mr. Dutta did not receive
such letter.
Mr. Dutta has vehemently denied the
submission of Mr. Basu Mallick.
I considered it appropriate to inquire from all
the six petitioners, who are present in Court, as to
whether they are willing to proceed with the writ petition
further or not. They all answered in the negative.At this stage, Mr. Bhattacharya, learned
senior advocate appearing for the petitioners submits
that on September 24, 2014 after the writ petition was
taken up for consideration, some unidentified miscreants
had threatened the petitioner no. 1 and his family
members if the former pursues the writ petition to its
logical conclusion and that such incident was reported to
the Superintendent of Police, Howrah, Rural. The written
complaint of the petitioner no.1, produced in Court today
by Mr. Bhattacharya, shall be retained with the records.
It cannot be ignored that this Court has
wasted precious judicial hours for the last few days while
hearing this writ petition. It is open to a litigant to
withdraw his writ petition at any time but while granting
leave to withdraw the writ petition, the aspect of wastage
of precious judicial hours cannot fade away from the
consideration of the Court. It has been made clear to the
six petitioners that they may withdraw the writ petition
but heavy costs are likely to be imposed, which they will
have to bear and that the Court would ensure that the
costs are recovered from them in accordance with law.
The petitioners are, therefore, directed file an
affidavit placing on record their desire not to proceed with
the writ petition further. Let such affidavit be filed by the
petitioners by tomorrow.
Put up this writ petition on Friday next
(28.11.2014) under the heading ‘To Be Mentioned’.This writ petition being W.P.27619(W) of 2014
shall stand detagged from the writ petitions, viz. W.P.
29606(W) of 2014, W.P.29607(W) of 2014 and W.P.
30510(W) of 2014. The above three writ petitions shall be
heard together.
